You are responsible for maintaining the confidentiality of your password and account and are fully responsible for all activities that occur under your password or account. You agree to immediately notify TSO of any unauthorized use of your password or account or any other breach of security and ensure that you exit from your account at the end of each session.
We are the owner or the licensee of all intellectual property rights in OpenUpLabs and the trade marks set out therein. Those works are protected by copyright and trade mark laws and treaties around the world. All such rights are reserved.
Commentary and other materials posted on OpenUpLabs or linked to or from OpenUpLabs are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials or content by any visitor to OpenUpLabs, or by anyone who may be informed of any of its contents.
TSO aims to update OpenUpLabs regularly, and may change the content at any time. If the need arises, TSO may suspend access to OpenUpLabs, or close it indefinitely. Any of the material on OpenUpLabs may be out of date at any given time, and TSO are under no obligation to update such material.

Whenever you make use of a feature that allows you to upload material to OpenUpLabs, or to make contact with other users of OpenUpLabs, you must comply with the content standards set out in TSO’s acceptable use policy. You warrant that any such contribution does comply with those standards, and any applicable law and you indemnify us for any breach of that warranty.
Any material you upload to OpenUpLabs will be considered non-confidential and non-proprietary, and TSO have the right to use, copy, distribute and disclose to third parties any such material for any purpose. TSO also has the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to OpenUpLabs constitutes a violation of their intellectual property rights, or of their right to privacy.
TSO will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of OpenUpLabs.
TSO has the right to remove any material or posting you make on OpenUpLabs if, in TSO’s opinion, such material does not comply with the content standards set out in TSO’s acceptable use policy or it otherwise deems necessary.
In the case of content that includes computer code, you will accurately categorise and/or describe the type, nature, uses and effects of the materials when requested to do so by TSO.
You must not misuse OpenUpLabs by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to OpenUpLabs, the server on which OpenUpLabs is stored or any server, computer or database connected to OpenUpLabs. You must not attack OpenUpLabs via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and TSO will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use OpenUpLabs will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of OpenUpLabs or to your downloading of any material posted on it, or on any website linked to it.
You may link to TSO’s home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on TSO’s part where none exists.
You must not establish a link from any website that is not owned by you.
TSO’s site must not be framed on any other site. We reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with the content standards set out in TSO’s acceptable use policy.
Where OpenUpLabs contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.
The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to OpenUpLabs although TSO retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
TSO has not reviewed, and cannot review, all of the material, stored in OpenUpLabs or outputted by OpenUpLabs, and cannot therefore be responsible for that material’s content, use or effects. TSO does not endorse the material displayed or stored, or necessarily believe such material to be accurate or non-harmful. OpenUpLabs may store and return to you (or delete) content that is offensive, indecent, unlawful or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. TSO does not warrant or imply that OpenUpLabs does not contain any content that violates the rights of any third party (including intellectual property rights) or is subject to additional terms and conditions and TSO cannot be responsible for the same and TSO disclaims any responsibility for any and all harm resulting from the use of OpenUpLabs.
Abuse or excessively frequent requests to OpenUpLabs may result in suspension of your access. TSO, in its sole discretion, will determine abuse or excessive usage of OpenUpLabs. TSO will make a reasonable attempt to warn you prior to suspension.
Abuse includes content pasted, uploaded or otherwise transferred to OpenUpLabs which contains or installs any viruses, worms, malware, Trojan horses or other harmful or destructive content, or is spam, contains unethical or unwanted commercial content designed to drive traffic to third-party sites or boost the search engine rankings of third-party sites or to further unlawful acts, or mislead recipients as to the source of the material or is obscene, libelous or defamatory, hateful or racially or ethnically objectionable or violates the rights of any third party or is otherwise unlawful. Notwithstanding the foregoing, TSO does not, and cannot, monitor content.
